Training: Prosecutorial Discretion and Alternate Strategies

On Wednesday, June 28, 2017, Safe Passage Project is hosting a free in-depth training about prosecutorial discretion and alternate strategies to defend immigrant children. It will be from 5pm to 7pm at New York Law School (185 West Broadway, NY, NY). Rex Chen of Safe Passage Project and Jodi Ziesemer of Catholic Charities Community Services will build on their two well-received trainings on prosecutorial discretion in 2016.


ICE has the power to exercise prosecutorial discretion and put an immigration court case on hold. This training focuses on helping immigration lawyers prepare their requests to ICE, discuss recent trends, and explore alternative strategies for defending children if a request for prosecutorial discretion is unsuccessful.

Since Donald Trump became President, there is concern that ICE will stop exercising prosecutorial in a thoughtful and balanced manner.  This training will give tips on preparing a request for prosecutorial discretion, recent trends on ICE’s responses, and alternative strategies to pursue if ICE will not exercise prosecutorial discretion. Alternate strategies can include challenging proper service of the Notice to Appear and terminating the case because of government mistreatment of the child.

This training is suitable for attorneys regardless of whether they have attended any trainings about prosecutorial discretion in 2016. Although the training is free, we recommend that audience members register for it. Donations are welcome but not required. Spots for the training will be distributed on a first-come, first-served basis.  We are not offering CLE credit for the training.
