This training will prepare attorneys to litigate appeals to the Board of Immigration Appeals (BIA), by addressing the following topics:
- Different types of BIA appeals
- Assessing Immigration Judge decisions and factors to consider in determining whether to appeal to the BIA
- The nuts and bolts of filing an appeal, from the notice of appeal to successful briefing, as well as an orientation to the BIA Practice Manual and key deadlines
- Standards of review in BIA appeals
- Overview of frequently raised issues on appeal, from fear-based claims to removability to discretion
- Recent changes at the BIA
