Safe Passage Project Files Amicus Brief Defending Two Children’s Right to Stay Safe

Safe Passage Project, together with partner organizations, filed an amicus brief in support of two Special Immigrant Juvenile siblings’ challenge to the Third Circuit Court of Appeals of a BIA decision denying their motion to reopen based on approved SIJS. As we state in the amicus brief:

“The stakes are high and concrete. A child denied reopening becomes removable to the country, and often to the very home, that a state court has already found, and USCIS has affirmed, is unsafe for that child. Amici respectfully urge the Court to hold that an approved SIJS petition cannot be deemed “too speculative” to support granting a motion to reopen, so that the children Congress chose to protect are not denied that chance for the sole offense of waiting their turn in line. This Court should not allow the Board to slam shut the door Congress left open for vulnerable children.”
